Generation 2000 Limited (hereinafter referred to as G200 Company) registered “G2000” trademark at State Trademark Bureau on December 25, 1991. This trademark enjoys high reputation in Chinese Mainland.
On September 7, 1997, Zhenhong Science & Technology Consulting Service Center (hereinafter referred to as Zhenhong Technology), which located in Xihu District of Hangzhou, registered “2000” trademark for “socks, glove, necktie” commodities in category No. 25.
On December 4, 2000, G2000 Company submitted application to China Trademark Review & Adjudication Board (hereinafter referred to as the Board) for cancellation of “2000” trademark of Zhenhong Center. The Board concluded determination (2005) No.0066 on January 10, 2005, holding that arguments of G2000 Company were not tenable and “2000” trademark of Zhenhong Center was maintained. G2000 Company refused to accept the determination and entrusted lawyer Dai Futang and Zhang Yazhou from Beijing Unitalen Law Firm to bring an action on February 4, 2005 to Beijing No.1 Intermediate People's Court. The appellate court judged on June 21, 2005 that “2000” trademark of Zhenhong Center is quite similar to “G2000” trademark of G2000 Company and confuses consumers' recognition of commodities; therefore, the court cancelled determination (2005) No.0066 made by the Board.
