Ministry of Public Security and the State Administration for Industry and Commerce Jointly Cracking Down on Trademark Infringements

 

In order to strengthen the cooperation in protecting exclusive rights of trademarks, the Commercial Crime Investigation Office under the Ministry of Public Security and the China Trademark Office of the State Administration for Industry and Commerce of China jointly drafted Provisional Regulations for Strengthening the Cooperation in Cracking Down Trademark Infringements (“Provisional Regulations”), which were promulgated for execution a few days ago.

The Provisional Regulations, including 17 articles, clearly define the scope, tasks and mechanisms of the cooperation, based on case reports, between the Ministry of Public Security and the Administration for Industry and Commerce. The Provisional Regulations also provide practical regulations on dealing with certain important issues often occurred from the process of cooperation between the two parties, such as issues for delivery of the cases involving crimes, judgment of the infringement, and collaboration on investigations.
