Chongqing Jiali Lighting Co., Ltd. applied with the Patent Reexamination Board of SIPO (The Board) for invalidating the design patent No. 02355885.7 for motorcycle headlight (storm II) in the name of Tianli Lighting Co., Ltd. In his decision No. 7061, the Board decided to invalidate the design patent. Dissatisfied with the decision, Tianli Lighting Co., Ltd. appealed to Beijing No. 1 Intermediate People’s Court. Chongqing Jiali Lighting Co., Ltd. entrusted Mr. Hongxun Liu, Patent Attorney, and Mr. Runfeng Gu, Attorney at Law, both from Unitalen, to attend the court hearing and rejoinder. On November 14, 2005, Beijing No. 1 Intermediate People’s Court issued a verdict, sustaining the decision No. 7061 made by the Patent Reexamination Board.
Tianli Lighting Co., Ltd. further appealed against the verdict. On March 9, 2006, Mr. Hongxun Liu and Mr. Runfeng Gu represented Chongqing Jiali Lighting Co., Ltd. in the court hearing and rejoinder at the Beijing Supreme Court. On March 20, 2006, Beijing Supreme Court issued the final verdict, rejecting the appeal made by Tianli Lighting Co. and maintaining the decision in the first instance. Thus Unitalen has successfully assisted Chongqing Jiali Lightiung Co., Ltd. in this patent litigation.
